This panel will discuss and update for 2012 the legal and ethical issues in representing the sports client in the negotiation of deals in sports in film and television, including network deal memos and production agreements, and counseling, advising and protecting the athletes and their rights in such negotiations, including labor-related issues in light of collective bargaining agreements and their impact in this area, including the NFL and the NBA. This panel will focus on the legal and business aspects of representing entertainers and athletes, or the employers with which they deal, and the issues, opportunities and pitfalls that may be encountered from the standpoint of labor, employment and benefits law during this process. Panelists will illuminate the role of labor unions, including the decision on whether to join a union, and will discuss collective bargaining agreements, allowable restraints on “free agency,” non-compete and confidentiality agreements, federal preemption, and arbitration. The panel will also discuss what the attorney needs to do in order to properly advise on executive and employee benefits programs so corporate leadership may focus on its creative vision. Finally, the panel will explore the circumstances under which ADR may be a constructive dispute resolution tool as an effective option to unpredictable and consuming litigation.

This panel will explore detection of alcoholism and substance abuse and treatment of the addict in the sports, music and entertainment industries. Included will be a discussion of the “poly addicted person”, gambling and sex addictions, the obligations of sports agents to their clients and teams, highlights of standard player’s contracts in the sports industry, Florida’s Marchman Act (under which a Petition for Involuntary Assessment may be filed when there is good faith reason to believe an individual is substance-abuse impaired and because of that impairment, has lost the power of self-control with respect to substance use), and ethical issues confronted by legal counsel in addressing these areas of concern.

Of course, estate planning and writing a will are something that everyone has to think about at some stage. However, by putting plans into place regarding what you would like to happen when you are no longer around, you can reach peace of mind that your wishes will be respected. This panel will, therefore, discuss matters including how to make a will online, what to think about when writing a will, and the types of questions you will need to ask a solicitor during the will writing process. When it comes to estate planning, you will also want to consider designating someone to take care of your finances if you are unable to do so for yourself – this involves naming someone you can entrust with wielding durable power of attorney when planning your estate with a lawyer. The discussions will consider the sophisticated vehicles available for planning mechanisms and tools utilized to protect the assets of the celebrity client. Such vehicles will be critical to a practitioner’s representation, and will include the various tactical considerations for the avoidance of issues with the Internal Revenue Service and other pertinent governmental entities. Professionalism and courtesy will also be addressed regarding handling the special needs of a sports or entertainment client.

Our symposium attendees and guests are invited to a special screening of CONCERT, which had its world premiere at the historic Cinema Paradiso at the 2011 Ft. Lauderdale International Film Festival. Set at a benefit concert, music, art and creativity merge in this introspective look into the world of an American singer-songwriter, where every song has a story and every story has a song. The concept behind the film was borne out of a live acoustic solo concert benefit performance. The purpose was to develop a documentary that addressed the question as to why artists create their works and what drives an artist to write a musical composition. In this respect, the goal was to provide a reflective look into the genesis of original music, its importance to the creative process, the significance of the message to be delivered and the artistry of music. To accomplish that, the film presented a series of interviews on why each song was composed and what the artist meant to convey to the listener. In the end, the producers wanted the audience to understand the texture that lives within a musical composition, the mosaic of stories that unfold in each song, and the artistic relevance of music to our world.

Darren Heitner created Sports Agent Blog as a New Year's Resolution on December 31, 2005. Originally titled, "I Want To Be A Sports Agent," the website was founded with the intention of causing Heitner to learn more about the profession that he wanted to join, meet reputable individuals in the space and force himself to stay on top of the latest news and trends.

Heitner now runs Heitner Legal, P.L.L.C., which is a law firm with many practice areas, including sports law and contract law. Heitner has represented numerous athletes and sports agents as legal counsel. He has also served as an Adjunct Professor at Indiana University Bloomington from 2011-2014, where he created and taught a course titled, Sport Agency Management, which included subjects ranging from NCAA regulations to athlete agent certification and the rules governing the profession. Heitner serves as an Adjunct Professor at the University of Florida Levin College of Law, where he teaches a Sports Law class that includes case law surrounding athlete agents and the NCAA rules.
